POSH: -The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 is legislative act in India that seeks to protect women from Sexual Harassment at their workplace. Most Indian employers have implemented the law as it is a legal requirement that workplace.

This act was essentially derived from the Vishaka Guidelines. The guidelines were formulated after the landmark case Vishaka and others v. state of Rajasthan. This case established that actions resulting in a violation of one’s rights to ‘Gender Equality’ and ‘Life and Liberty’ are in fact a violation of the victim’s fundamental right under Article 19 (1) g. The case ruling established that sexual harassment violates a woman’s rights in the workplace and is thus not just a matter of personal injury. This case ruling had issued Vishaka Guidelines under Article 32 of the Constitution of India. The Supreme Court had made it mandatory that these had to be followed by all origination until a legislative framework on the subject has been drawn-up and enacted.

We consciously worked towards emancipation of women at workplace which is in form of equal pay for a position, ensuring maternity benefits to the best possible extent, ensure safety & security for ladies especially during pandemic times and last but not least“implementation of POSH ACT(Prevention, Prohibition and Redressal)”.

Macawber Beekay has constituted an Internal Complain Committee(ICC). This committee has written guideline to provide protection against sexual harassment of women at workplace and the prevention and redressal of complaints of sexual harassment and matters related to it. These guidelines extends to all employees including individuals coming to the workplace for employment or for any other purpose whatsoever including but not limited to visitors, vendors, contractual resources, secondees and applies to any alleged act of sexual harassment against persons at workplace, whether the incident has occurred during or beyond office hours.

In India, a woman is sexually harassed every 12 minutes. Due to industrialisation, globalisation, development in various fields, role of women is changing rapidly in India. Today, women in India are showing progress in almost all the fields such as education, economics, politics, media, art, space and culture, service sectors, science, and technology, etc. Despite of rising incidences of sexual harassment, their reporting is almost nil as women fear loss of personal & professional reputation and livelihood owing to the social stigma this is the reason there is a great requirement of continuous training so that female employee feel secure and come forward.

“While a murder destroys the physical frame of the victim, sexual harassment degrades and defiles the soul of a helpless woman.

We understand sensitivityin implementation of POSH, but we also know effectiveness of imparting knowledge and training session for both male and female employee. This is the reason we constantly take multiple efforts to make them understand their duties and their right with respect to this law.We organise induction and training session to educate and empower our male and female employees about their right as well as duties about Sexual Harassment of Women at the Workplace (Prevention, Prohibition and Redressal) Act as per guidelines of Government of India. This training session also helps our employees to be sensitive towards female employees. Female employees, therefore, feel safe and secure at working place.

Referring to this,Macawber Beekay conducted POSH awareness training sessions through virtual platform even in these tough pandemic times in which all our employees participated with great zeal. These training sessions are extremely effective as employees are participative and examples quoted were very relevant.

It is equally important to train InternalCommittee member’s to make them learn to investigate and redress sexual harassment complaints within the organization. In line to solve the purpose, HR Departmnet conducted three days training and workshop session which included activities, case studies and role plays.
